Terms and Conditions of Sale

ARTICLE 1. RECIPIENTS AND ACCEPTANCE

These Terms and Conditions apply to any individual or legal entity registering or purchasing a service (Jet Ski, Boat, Kayak, Kitesurfing, Wing Foil) from SARL RAIATEA EXPLORER. The subscriber undertakes to ensure that these Terms and Conditions are approved by all registered participants.

ARTICLE 2. REGISTRATION AND PAYMENT TERMS

• Deposit (Operating Costs): All bookings (except kayaking) require a 20% deposit. This amount is referred to as "non-refundable operating costs" covering administrative costs and equipment immobilisation.

• Balance: The balance must be paid in full before the start of the activity, by bank transfer, online payment, credit card or cash (XPF).

ARTICLE 3. CANCELLATION AND WEATHER

• By the Customer: For cancellations made more than 48 hours in advance, the 20% deposit will be retained by the company. For cancellations made less than 48 hours in advance, no refund will be given and the full amount will be due.

• By the Company: In the event of cancellation by RAIATEA EXPLORER (weather, safety, breakdown), all sums paid, including deposits, will be refunded.

• Weather: As activities take place outdoors, only the company can judge whether they are feasible. Rain is not a valid reason for cancellation by the customer.

ARTICLE 4. HEALTH, SAFETY AND FITNESS

• Fitness: The customer certifies that they are in good health and have no contraindications (heart or respiratory conditions, epilepsy, pregnancy, back problems).

• Substances: Access will be denied to anyone under the influence of alcohol or drugs, without refund.

• Exclusion: The company reserves the right to exclude any participant whose behaviour endangers others or fails to comply with the instructions of supervisory staff.

ARTICLE 5. SPECIFIC PROVISIONS AND EXEMPTIONS

• Jet Ski: Drivers must be at least 16 years old, passengers must be at least 5 years old. Maximum weight 200 kg per machine. Excess in the event of damage: 150,000 XPF.

• Kayaking: Self-guided hire limited to the lagoon (no access to the passes or coral reef). Excess from 10,000 XPF.

• Winter sports: The customer assumes the risks inherent in winter sports. Excess from XPF 50,000.

ARTICLE 6. LIABILITY AND PERSONAL EFFECTS

RAIATEA EXPLORER has professional liability insurance. However, the company accepts no responsibility for loss, theft or damage to personal belongings (glasses, telephones, cameras, etc.). Customers are responsible for any damage they cause to themselves or to third parties during independent activities.

ARTICLE 7. IMAGE RIGHTS AND PERSONAL DATA (GDPR)

• Image rights: Unless otherwise specified in writing, the customer authorises the company to use photos/videos taken during the activity for promotional purposes (website, social media).

• GDPR: The data collected is strictly limited to booking management and security purposes. In accordance with the law, customers have the right to access and rectify their data by contacting customer service.

ARTICLE 8. DISPUTES AND APPLICABLE LAW

These GTC are subject to the applicable law in French Polynesia. In the event of a dispute and in the absence of an amicable agreement, exclusive jurisdiction is attributed to the courts of Papeete, notwithstanding multiple defendants or the introduction of third parties.

ARTICLE 9. FAIR VOUCHERS AND GIFT VOUCHERS

9.1. Payment Terms and Validity

• Full payment: As a rule, "Salon Vouchers" must be paid for in full at the time of purchase in order to be valid.

• Instalment Payment: In exceptional cases, payment in two (2) instalments may be accepted. In this case, the first instalment is considered a non-refundable deposit. The voucher will only be considered issued and valid once the total balance has been received.

• Validity period: The voucher is valid for a fixed period of 6 months from the date of purchase (first payment). After this period, the service is considered forfeited: no refund, extension or credit note will be granted.

9.2. Terms of Use

• Reservation required: Obtaining a voucher does not guarantee immediate availability. The beneficiary must reserve their slot with RAIATEA EXPLORER.

• Cancellation and No-Show: In the event of a no-show, the voucher shall be considered definitively used.

• Nature of vouchers: These vouchers are firm, non-transferable, non-refundable, non-extendable and non-renewable.
